This can be used to challenge unreasonable and unlawful decisions by the local authority, or policies which contradict or cite higher thresholds than legislation. We can look at the refusal to assess, refusal to provide transport, failing to provide provision in the EHCPlan or providing social care assessments and exclusions. In many cases a pre-action letter can be useful in putting the local authority on notice where there has been unlawful behaviour
